Since 1st October 2011 all employers receiving applications or invoices for payment have to serve two notices in respect of the applications or invoices received. If they do not then the contractor (or subcontractor) may be entitled to be paid the full amount of the application or invoice without deduction immediately.

Since 1st October 2011 payment of sums due under a Construction Contract cannot be made dependent on the fulfilment of an obligation under another contract. This means that the payment of retention or the final sums due under a contract cannot be made dependent on the issue of certificates under the Main Contract.
